Alternative Dispute Resolution

Overview

Anderson Kill is committed to helping our clients realize the promise of ADR as a speedy, cost effective, confidential and fair method of resolving disputes.  Anderson Kill attorneys have participated as advocates or neutrals in numerous arbitrations, mediations, and non-binding neutral evaluations.  ADR may not be appropriate, or even possible, for all disputes, but our lawyers use it where it offers the best possible solution for our clients.  Our wealth of litigation and, in particular, trial experience in courts and before arbitration tribunals informs and enriches our conduct of ADR matters. Our arbitration knowledge is supplemented by our expertise in international commerce, corporate and transactional matters, and insurance law. Our ADR team includes a former New York State Supreme Court Justice who was a settlement leader and law school presenter in this area.

We have experience representing clients both domestically and internationally in a number of areas, including insurance coverage, employment issues, contract and commercial disputes, construction matters, financial – investor/broker disputes, trademark.

Our arbitration clients include numerous consumer products companies and manufacturers, as well as financial institutions.  We have represented clients in a wide range of disputes in ADR forums involving, among other things, the purchase and sale of components, raw materials and products; licensing agreements; and insurance coverage.

In the field of international arbitration our practice draws upon our in-depth knowledge of international arbitration rules and forms, (ARIAS, Bermuda, CDR, JAMS) including those of the International Court of Arbitration of the International Chamber of Commerce (ICC), the London Court of International Arbitration (LCIA) and the United Nations Commission on International Trade Law (UNCITRAL) .

We have obtained favorable results in arbitrations in Europe and the United States for domestic clients as well as for companies headquartered in Europe, Asia, and Central America. Anderson Kill has long-standing relationships with law firms around the world that provide knowledge of local law and practice when needed.

Our lawyers also serve as arbitrators and mediators for the American Arbitration Association (AAA) and on mediation panels in the federal and state courts.  We also work in the forefront of alternative dispute resolution advancement, lecturing and authoring articles on ADR and working in foreign countries to promote the use of ADR.
