Dennis J. Nolan, a shareholder in Anderson Kill's New York office, concentrates his practice in commercial litigation with an emphasis on insurance recovery. He also has extensive experience litigating complex chapter 11 reorganizations. He co-chairs the firm's Bankruptcy Group,  Restaurant, Retail & Hospitality Group, and the Marine Cargo Group.

Dennis advises policyholders with respect to a broad range of insurance policies, including Marine Cargo, Cyber, Directors and Officers, Errors and Omissions, Employment Practices Liability, Marine Cargo, and Commercial General Liability policies. His clients in insurance recovery cases include companies in the financial services, technology, manufacturing, fitness, and commodity trading industries. He also has extensive experience representing debtors, creditors’ committees, and unsecured creditors in complex chapter 11 cases.

Dennis has represented clients including a major financial services institution in an Errors & Omissions and Directors & Officers insurance dispute in connection with a bankrupt subsidiary; a leading technology company in London arbitration of an insurance coverage dispute hinging on policy periods; and "feeder fund" defendants in the Madoff bankruptcy.

He has also handled diverse matters in commercial litigation, including employment and partnership disputes, copyright infringement, fraud and breach of fiduciary duty claims against officers and directors, and antitrust. In the wake of Superstorm Sandy, Dennis provided pro bono counsel to homeowners who suffered property damage in the storm. In prior years, he also had significant responsibility for claims filed with the September 11th Victims' Compensation Fund.

  • Represent a fitness company in a Bermuda Form arbitration relating to insurance coverage under an Employment Practices Liability policy.
  • Part of trial team in action seeking to obtain insurance coverage for manufacturer for nationwide claims alleging asbestos bodily injury.
  • Represented a European technology services company in London arbitration, as well as related litigation, in connection with insurance coverage under an E&O insurance policy.
  • Represented a major financial services institution in an Errors and Omissions and Directors’ & Officers’ insurance dispute.
  • Represented a private trade advisory association in action seeking reformation of insurance policy.
  • Represented metals trader in theft of cargo claim under an “Ocean Marine Cargo Policy.”
  • Filed amicus brief on behalf of entity seeking coverage under a Computer Systems Fraud rider to a crime loss insurance policy for fraudulent claims entered into entity’s systems.

COMMERCIAL LITIGATION

  • Represented prominent company in the spirits industry in commercial litigation against its former members and employees seeking recovery under promissory note and defending against breach of employment contract claims.
  • Represented individuals’ oral partnership claim seeking damages for breach of partnership agreement and fiduciary duties, unjust enrichment, self-dealing, and conversion claims involving real estate interests held in various trusts and LLCs.

Profile

Dennis J. Nolan, a shareholder in Anderson Kill's New York office, concentrates his practice in commercial litigation with an emphasis on insurance recovery. He also has extensive experience litigating complex chapter 11 reorganizations. He co-chairs the firm's Bankruptcy Group,  Restaurant, Retail & Hospitality Group, and the Marine Cargo Group.
