Hon. Ethan Greenberg (Ret.) is a Shareholder in Anderson Kill's New York office and co-chair of the firm's White Collar Defense Practice Group, as well as a member of the firm's Corporate and Commercial Litigation Group. He represents clients in sophisticated commercial litigation, white collar defense and internal investigations.

Prior to joining Anderson Kill, Judge Greenberg was an Acting New York State Supreme Court Justice in Bronx County. In that role he presided over more than one hundred trials, administered calendar and motion parts, conducted hearings and supervised grand juries. He also received specialized training and assignments for domestic violence cases. Previously, Judge Greenberg was a Criminal Court Judge with the New York City Criminal Court.

Before joining the judiciary, Judge Greenberg was a partner at a national law firm based in New York, where he practiced civil and criminal litigation in federal and state courts. He represented clients in a broad range of matters including cases involving insurance coverage, asbestos, securities law, trade dress, employee raiding, and aircraft manufacturer warranties. He was previously a partner at a leading New York law firm where he practiced civil and criminal litigation in matters involving securities fraud, construction delay, Superfund site cleanup, antitrust and alternative energy.

Judge Greenberg serves as an Adjunct Professor at Fordham and Cardozo Law Schools, where he has taught classes in Constitutional Criminal Procedure, New York Civil Practice, and New York Evidence.

After graduating law school, Judge Greenberg was an Assistant District Attorney in the New York County District Attorney's Office, serving under Robert Morgenthau in the Trial Bureau, Appeals Bureau, and Special Projects Bureau. As an Assistant D.A. he tried cases, argued appeals, and conducted investigations and grand jury presentations.

  • Part of team representing relatives of people killed on September 11 in MDL anti-terrorism litigation against foreign governments, banks, and charities.
  • Represent potential defendant and third-party witnesses in criminal and quasi-criminal governmental investigations.
  • Assist in representation of religious organizations involved in Child Victims Act litigation.
  • Represented Canadian manufacturer of transportation equipment in various U.S. matters.
  • Served as lead attorney and national coordinating counsel (selecting and supervising numerous local counsel) in defense of over ten thousand related asbestos exposure claims brought by railway workers in multiple states. Crafted structure for global settlement including all relevant locomotive manufacturer defendants, their corporate successors, and historical insurers.
  • Represented related firms engaged in brokerage of complex money market instruments.Both prosecuted and defended “employee raiding” and “non-compete” cases in courts and in arbitration proceedings.
  • Represented major investment bank engaged to build an electric cogeneration plant and sell to a Virgin Islands public utility sixty percent of power needed by the island of St. Croix.
  • Assisted in conducting injunction proceedings against Governor, utility, and disappointed competing bidders before District Court. Conducted related subsequent AAA arbitration.
  • Assisted in representation of client charged in high profile criminal securities fraud case and related civil litigation.
  • Assisted in representation of City in defense of construction delay claims made in connection with building municipal sewage treatment plant.
  • Represented pharmaceutical company in which the client (a major private equity firm) had substantial investment in various litigations, including defense of injunction action instituted by purchaser of related business.
  • Represented estate of original owner of pharmaceutical company in defense of CERCLA action for environmental clean-up of factory site.
  • Represented international luxury real estate brokerage in defense of injunction proceeding brought by terminated Florida affiliate.
  • Represented major multi-national financial services corporation in arbitration and subsequent appeal concerning claim brought by disappointed participant in merger related securities “lottery.”
  • Assisted in conducting internal investigations and related negotiations with regulatory/prosecutorial agencies in connection with allegations of illegal corporate campaign contributions; ticket scalping by luxury hotels; and bribery and kickback scheme for building maintenance contracts.
