NJ Justices Fortify Insureds In Asbestos Coverage Gap Fight

Law360 reports: "New Jersey’s high court bolstered policyholders embroiled in complex multiyear insurance disputes by ruling Wednesday that Honeywell International Inc. doesn’t have to help pay for asbestos injury suits filed after coverage for such claims became unavailable."

Anderson Kill's Bob Horkovich highlighted the court's rejection of an insurance industry bid to nullify the "unavailability rule."

"New Jersey refused to burden policyholders with a portion of covered losses because of ‘equity’ as the insurance industry advocated,” Horkovich said.
