Robert M. Horkovich and Pamela D. Hans to Speak at RIMS 2014

Anderson Kill is pleased to announce that two attorneys have been selected to present at three sessions at Risk & Insurance Management Society's 2014 Annual Conference & Exhibition in Denver, Colorado on April 27 - April 30th.

The sessions and speakers are as follows:

“Ten Tips for Getting Claims Paid” – Robert M. Horkovich - April 29, 2014 from 10:30 a.m. - 10:55 a.m.

Getting a corporate insurance claim paid is rarely easy-the larger, the more difficult. Get practical tips for keeping the claims process moving, minimizing resistance and maximizing coverage. Learn to factor the solvency of your insurance companies, value fast payment, include forum sensitivity and get the right people to the negotiating table.

“Getting the Most Out of Your Environmental Coverage” – Pamela D. Hans - April 30, 2014 from 10:15 a.m. - 11:15 a.m.

Like most liability insurance, environmental coverage is crucial when you get sued. Clean-up and financial assurance, however, are generally never that simple. Companies must tailor coverage to meet these risks both anticipated and unanticipated against the backdrop of an array of authorities such as voluntary clean-up, contractual obligations, threatening letters, bonding requirements and climate change. This experienced panel will sort through pros, cons and pitfalls by using real examples to show you how to get the cost out of your environmental insurance.

"When Covered and Uncovered Losses Coincide” – Robert M. Horkovich - April 30, 2014 from 2:00 p.m. - 3:00 p.m.

You can't be a little bit pregnant, but an insurance company can declare that you only have a partially covered insurance claim. In many cases, covered and uncovered losses may be difficult to disentangle. An insurance company may argue that you only have partial or no coverage. In some states and cases, for example, covered wind claims may be separated from uncovered flood claims; in others, anti-concurrent causation clauses arguably may bar coverage. If part of a loss is caused by a non-covered event do you lose all coverage? Who has to prove what? In California, the State Supreme Court has held that when a loss is covered and non-covered, all is covered unless the insurance company can prove how much is not covered. Other states have ruled differently. This session will show risk managers how to document covered claims when they're mingled with uncovered and make the case for complete coverage when covered/uncovered can't be separated.
