Calif. Justices Set Montrose’s Excess Enviro Coverage Path

Experience

ResinTech. The New Jersey-based water treatment products company filed suit in U.S. District Court in New Jersey against AIG Specialty Insurance Co. and an insurance broker in November 2021 seeking to recover $1.5 million in state and county fines for alleged pollution stemming from wastewater discharges. The insurance policy in question has a section providing coverage for “sudden and accidental pollution.” AIG claims the section is not applicable to this claim because it never received a schedule of locations. ResinTech is also suing its insurance broker for failing to submit said schedule of locations to the insurance company.
Radiac Adhesives. Anderson Kill represents Radiac Adhesives in New Jersey Superior Court, Essex County, against ten insurance companies for coverage for environmental cleanup in excess of $9 million at a former facility now used as a day care center. The issues in dispute include missing policies, trigger of coverage, and allocation among insurance companies. Radiac’s motion for summary judgment is pending. Radiac has settled with three of the insurance companies and is in mediation with the others.
Tri-State Mall. Anderson Kill represented Tri-State Mall (New Jersey) in pursuing recovery for $3.5 million in damages sustained because of groundwater contamination caused by a dry cleaner’s disposal practices. The case settled.
