Insurance Industry Still On Alert After Tariff Ruling

The U.S. Supreme Court ruling last week striking down President Donald Trump's emergency tariffs was an overall positive for the insurance industry, but experts say elevated prices could still lead to higher claims costs and premiums...

At a conference Wednesday on trends in directors and officers coverage hosted by the policyholder-side firm Anderson Kill, panelists noted that prevailing economic and geopolitical trends can open company officials to risks that could lead to D&O claims.

Those risks could relate to disclosures to investors of how company officials see geopolitical trends affecting their business. Stacy Parker, a managing director at Aon and panelist who discussed the Supreme Court's tariff decision, said tariff refund suits filed by companies like FedEx and Costco could implicate complex issues.

" I do think that those are going to bleed into D&O issues," Parker told the panel.

"It's the one event, and then it just spirals out to so many different layers of litigation that are now boardroom issues affecting our clients, the directors and officers," she said.
