A Connecticut woman has asked a state court judge to grant her a $275,000 judgment against an attorney who has allegedly been incommunicado since last week when he missed the first payment under a settlement agreement in her malpractice suit against him.

Karen Alsup and her attorney, Daniel McGuire of Anderson Kill PC, said in court documents filed Monday that so far it's been crickets from solo practitioner Neal P. Rogan, who was scheduled to make the first of two $75,000 settlement payments on July 20.

McGuire called this "highly suspect" and "indicative of evasive behavior" in an affidavit.

The settlement between Alsup and Rogan was supposed to bring to a close a malpractice lawsuit Alsup filed after Rogan allegedly used her retainer to cover personal expenses before trying to persuade her to loan him hundreds of thousands of dollars to pay his back taxes.

The parties settled earlier this year, according to the affidavit, with an agreement that Rogan would make the first payment last week and the second in July 2024.

Days before the bill came due, however, Rogan reportedly reached out to McGuire saying he wouldn't be able to pay it because he was waiting on more than $300,000 in payments from the federal Criminal Justice Act Program.

"It brought me no pleasure filing this," McGuire told Law360 Wednesday. "Ms. Alsup gave attorney Rogan every opportunity to do the right thing. It was personally difficult for me to do it, because I don't like having to file against another professional."
