AI’s impact on insurance can be considered in two fronts: claims and insurance company operations. In terms of claims, artificial intelligence tools permit humans to make bigger and more grandiose mistakes — and so, incur new kinds of liability. In a notable recent instance, an attorney used ChatGPT to generate a brief citing multiple court decisions that turned out to be nonexistent. Liabilities that may arise out of similar errors include allegations of malpractice, defamation, copyright infringement, fraud — and even bodily injury. How will insurance respond? Anderson Kill’s experience suggests that when faced with novel claims, insurance companies get creative in finding ways to avoid paying – and AI can be counted on as a willing partner in such endeavors. In terms of operations, insurance companies will use AI to assist in underwriting and claims handling. Exactly how remains to be seen, but insurance companies and regulators are scrambling to figure out what comes next. This presentation by a former NYS insurance commissioner and a panel of leading brokers and coverage lawyers will canvass the issues raised by AI on both fronts, and is sure to be an interesting and thought provoking event. We hope you can join us.
