When your insurance company refuses to settle a claim, it may be exposing your company to losses including punitive damages, harm to reputation, and other potentially uninsured claims.  What is a policyholder able to do when its insurance company refuses to settle a claim involving catastrophic personal injuries, wrongful death, or allegations of wrongdoing that could destroy your business?  Is a "win" at trial worth the risk to your company's brand, business relationships and reputation?  When your insurance company's decisions and refusal to settle a litigation compromise your company by exposing your business to uninsured losses, your insurance company is gambling with your business -- it is playing with house money.

This session will provide suggestions on how to make sure that your insurance company is considering fully your business's interests, including reputation, relationships with business partners, and other considerations.  It will also provide examples of litigation strategies that may be implemented to move a case to settlement in the face of an insurance company's refusal to pay.
