Disqualification motions have always been nebulous and controversial creatures of the law, subject to a variety of defenses depending on the jurisdiction. These defenses include: standing; waiver; a lack of potential trial taint; client hardship: and timely implementation of an ethical wall. This panel of experienced ethics and general counsel will review the current landscape of disqualification defenses, assess relevant trends in the case law and scholarly thinking, and provide tips and suggestions for avoiding or mitigating the risk of receiving a motion, and for interposing effective defenses if a motion is made.
