Over the past few years a number of events have forced corporate policyholders to focus on EPLI coverage. Following the rise of #MeToo movement and potential liability issues that it created for employers, the COVID pandemic raised different issues about workplace safety, mandatory employee requirements, shutting down workplaces and returning to work places. Employer liability, as always, trails behind the decisions employers have to make when addressing complex employee situations. EPLI coverage can respond in a number of ways to the claims that can arise in these contexts. Having the ability to make a clear argument for coverage can bring an insurance company into the process of resolving claims before they become public or turn into lawsuits. This panel will discuss best practices for addressing insurance coverage issues in these contexts under EPLI policies.
