In its 21st year this annual conference brings together leaders in D&O liability and insurance. Initiatives in ESG policies hold out the promise to corporations and investment companies of doing well by doing good. While contributing to sustainability and equity, ESG initiatives are also designed to meet criteria imposed by investors and insurance companies. At the same time, risks and mis-steps associated with ESG have surfaced. The SEC has begun cracking down on companies and investment vehicles alleged not to have followed through on implementing their stated ESG commitments. In some arenas an ESG backlash has developed, as states seek to penalize certain ESG investment practices, and some shareholders challenge ESG-related policies.
In this two-hour conference, top insurance recovery experts, defense counsel, and insurance brokers will address the benefits and risks of ESG from an insurance perspective. We'll begin with a brief historical look at D&O, focusing on how ESG expectations may be transforming shareholders' expectations and demands. We will move on to address ESG's impact on insurance companies' underwriting systems, and then to D&O coverage issues likely to arise related to liabilities arising from alleged ESG failures or from the consequences of ESG backlash. Finally, we will review recent D&O coverage developments with an eye to trends in coverage and dispute points.
