Anderson Kill Partners with RIMS and PERK, A Decade of Educational Programs

Anderson Kill is pleased to announce that this year marks the ten year milestone for having been selected by the Risk & Insurance Management Society (RIMS) to partner with the association to provide timely, educational programs to its members and industry experts through the PERK program..

In 2016, Anderson Kill will provide programs on four topics addressing risk managers' core responsibilities and most pressing challenges. The four sessions are:

Everything a Risk Manager Needs to Know About D&O Liability and Insurance
While D&O insurance provides essential liability protection to directors, officers and companies, the claims process is a minefield for policyholders. A risk manager needs to know which policy provisions to insist on and which to avoid as well as how countering typical insurance company defenses once a claim is filed, and how to keep an insurance company on board while settling a suit. This session will cover these essentials. Key policy language issues include “severability” of coverage for insurers not implicated in wrongdoing; priority of payment provisions when multiple parties are all seeking coverage; and the scope of “bad acts” exclusions. Settlement issues include satisfying the insurer’s desire for information and right to “participate” in a settlement, as well as whether settling with the primary insurance company can arguably endanger excess coverage.

Ten Tips for Getting Claims Paid
Getting claims paid is often difficult. Unfortunately, the larger the claim, the more difficult it is to get the claim paid. This session will provide risk managers and in-house counsel with a host of practical tips for keeping the claims process moving, minimizing resistance, and maximizing coverage. These are not your father's insurance tips. They include factoring such considerations as the solvency of your various insurers, the value of getting paid fast, forum sensitivity, and getting the right people on the other side of the negotiating table.

Strategies for Mitigating Risk Management and Data Breach Losses Arising out of Social Media Activity
Twitter, Facebook and other social media platforms have become fixtures in business. However, the use of social media brings myriad risks to your company including an increased risk of data breach. We will review the various types of risks associated with your company’s official use, as well as your employees’ personal use, of social media and offer pragmatic and effective solutions for identifying, avoiding and mitigating these risks through maximizing recovery under the various insurance policies that may provide coverage, including insurance policies that respond in the event of a social media-created data breach.

What Every Risk Manager Needs to Know About Data Security
Data security breaches continue to dominate the headlines, with more and more businesses, governmental authorities and other organizations falling victim. Now news comes that data breaches are actually under-reported. Thus, the problem is even worse than currently thought. To equip risk management professionals for this ever-growing threat, this session will examine key measures that businesses must take to protect themselves and comply with the law, including how risk managers can better work with their IT departments and in-house counsel, how best to deal with a data breach, and providing an overview of the types of losses that a serious breach will entail so that risk managers can make more informed assessments of this peril and adjust their risk management strategies and insurance purchases accordingly.
