“Three’s A Crowd” explores the unique ethical, strategic and privilege challenges that arise when insurance companies fund the defense but policyholders remain the true client. This presentation examines whether, when and why policyholders are entitled to independent defense counsel, how conflicts of interest affect defense, and how corporate counsel can successfully protect corporate interests, manage complex litigation and preserve privilege in the face of bet-the-company litigation.
