Robert M. Horkovich, Co-Chair of the Insurance Recovery Group of Anderson Kill & Olick, Named Policyholder Attorney of the Year by LexisNexis Insurance Law Center

New York, NY (March 24, 2009) – Anderson Kill & Olick, P.C. is delighted to announce that Insurance Recovery Group co-chair Robert M. Horkovich has been named Policyholder Attorney of the Year by the LexisNexis Insurance Law Center.
Mr. Horkovich shares the award with Roger Simpson of Cotkin and Collins, his co-counsel representing the State of California in its long-running insurance coverage dispute over the estimated $700 million cleanup of the Stringfellow waste site.
Mr. Horkovich’s major impact on the insurance law landscape in the past year includes a pair of decisions in State of California v. Continental Insurance. The first, handed down on Jan. 5, 2009 by the Fourth District of the California Court of Appeals, makes clear that liability insurance policyholders can recover the limits of each policy in effect during the course of continuous environmental damage in order to pay for the necessary cleanup. The second, issued on March 9, 2009 by the California Supreme Court, holds that that if a loss is caused by covered and uncovered events, and the policyholder can’t prove exactly how much is covered, the insurance company has to pay for the whole loss up to its policy limits. On a world-wide level, Mr. Horkovich has been engaged as insurance counsel on several significant projects by the United Nations.
Over the past decade, Mr. Horkovich has obtained over $5 billion in settlements and judgments from insurance companies for his clients. His victories include one of the top 10 jury verdicts in the United States in 2003, the top insurance recovery jury verdict in the United States in 2005, five landmark state Supreme Court decisions, eight jury verdicts and eight bench trial decisions in favor of the policyholder since 1994.
In building this litigation track record, Mr. Horkovich has followed a path blazed by Anderson Kill founding partner Eugene R. Anderson, a pioneer of insurance coverage litigation whom BusinessWeek has described as “the dean of policyholders’ attorneys.”
