Anderson Kill Team Achieves Settlements to Disputes in $2+ billion Owens Corning Bankruptcy Case 9/26/2006


The firm recently achieved settlements to disputes in its representation acting as Special Counsel to the Official Committee of Unsecured Creditors of Owens Corning and represents the interests of the bondholders and trade creditors, whose claims aggregate $2+ billion in Owens Corning’s $10 billion bankruptcy case. Anderson Kill’s lawyers litigated the substantive consolidation issues in the case and successfully obtained a pro-substantive consolidation ruling from District Court Judge John Fullam in 2004 following a 15 day trial in 2003 before District Judge Alfred Wolin, who was sitting as a Judge of the Federal District Court for the District of Delaware. The firm's success at trial was subsequently overturned on appeal, but the appellate decision enabled Anderson Kill's lawyers to embark on a new litigation strategy which later led to a settlement of all of the disputes in the case in late 2006. The case is ongoing pending plan effective date.
